Welcome to YouAreTube. By accessing or using our website at https://youaretube.com, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our service.

1. Service Description

YouAreTube provides a free, web-based platform that converts YouTube video URLs into downloadable audio and video files in various formats (MP3, MP4, FLAC, M4A, WAV, WEBM, AAC, OPUS, OGG, and others). The service is intended for personal, non-commercial use only.

The conversion process is performed by a third-party API (api2.youaretube.com) which handles the technical processing. By using our service, you acknowledge and agree that your requests are processed through this external service.

2. Acceptable Use

You agree to use YouAreTube only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

• Use the service to download or convert content that you do not have the legal right to copy
• Redistribute, sell, or commercially exploit any files downloaded through our service
• Use automated tools, bots, scrapers, or scripts to access or use the service in bulk
• Circumvent or attempt to circumvent any rate limiting, CAPTCHA, or abuse prevention mechanisms
• Use the service in any way that violates applicable laws or regulations in your jurisdiction
• Attempt to access or manipulate our servers, APIs, or infrastructure without authorization

3. Copyright and Intellectual Property

Our content: All content, design, layout, code, logos, and features of YouAreTube are owned by or licensed to us and are protected by intellectual property laws. You may not reproduce, redistribute, modify, or create derivative works from any part of this website without our prior written permission.

Third-party content: YouTube videos and their associated audio/video content are owned by their respective creators and rights holders. YouAreTube does not host, store, or distribute any video or audio content. We merely provide a tool that facilitates conversion of publicly accessible YouTube URLs into different formats.

4. Fair Use and Personal Use

We believe in the principle of Fair Use under copyright law. Converting a YouTube video for personal, educational, or transformative purposes may qualify as fair use in some jurisdictions. However:

• It is your responsibility to determine whether your use of converted files qualifies as fair use under your local copyright laws
• YouAreTube does not provide legal advice on what constitutes fair use
• Distributing, selling, or publicly performing converted content without permission from the rights holder may constitute copyright infringement
• We encourage you to seek permission from content creators before converting their work

5. DMCA Compliance

YouAreTube respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). If you believe that our service is being used in a manner that infringes your copyright, please submit a DMCA notice to [email protected] with the following information:

6. Age Restriction

YouAreTube is intended for users who are at least 13 years of age. By using our service, you represent that you are at least 13 years old. If you are under 13, you may not use our service. If we become aware that a user is under 13, we will take steps to restrict their access.

7. Third-Party Links and Services

YouAreTube may contain links to or integrate with third-party websites and services, including:

• YouTube: video hosting platform owned by Google LLC. Their Terms of Service and Privacy Policy apply.
• Conversion API: our backend service that processes conversion requests.
• Ko-fi: a third-party donation platform we link to for voluntary contributions.

We are not responsible for the content, terms, privacy practices, or availability of any third-party sites or services. You access them at your own risk.

8. Donations

YouAreTube is free to use. We accept voluntary donations through Ko-fi to help cover hosting and operational costs. Donations are entirely optional and do not grant any additional rights, features, or warranties. All donations are non-refundable.

9. Disclaimer of Warranties

YouAreTube is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the service will be uninterrupted, timely, secure, or error-free
• Warranties regarding the quality, accuracy, or completeness of converted files
• Warranties that the service will always support all YouTube videos or formats

10. Limitation of Liability

To the maximum extent permitted by applicable law, YouAreTube, its owners, operators, and affiliates shall not be liable for:

• Any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the service
• Any loss of data, profits, revenue, or business opportunities
• Any copyright claims brought against you by third parties related to files you convert
• Any damages resulting from service interruption, errors, or inability to use the service
• Any actions, errors, or omissions of the third-party conversion API

The total aggregate liability for any claims related to YouAreTube shall not exceed the amount you paid (if any) to use the service in the 12 months preceding the claim (which is typically $0, as our service is free).

11. Indemnification

You agree to indemnify, defend, and hold harmless YouAreTube and its owners, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the service in violation of these Terms
• Your violation of any third-party rights, including copyright and intellectual property rights
• Your distribution or use of converted files beyond personal, fair use

12. Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of YouAreTube at any time without prior notice. This includes, but is not limited to:

• Adding or removing supported formats or quality options
• Implementing rate limits or usage caps
• Changing the design, features, or functionality of the service
• Terminating the service entirely

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

13. Termination

We reserve the right to terminate or suspend your access to YouAreTube at any time, with or without cause, and with or without notice. Upon termination, your right to use the service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Seychelles, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Seychelles.

15. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of YouAreTube after any changes become effective constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, while the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and YouAreTube regarding your use of the service and supersede any prior agreements or understandings.
